The California Coastal Commission has approved a rule change aimed at easing the construction of affordable housing along the state’s coastline, a significant move in response to the ongoing housing crisis. This amendment, passed unanimously on November 6, 2023, allows developers more time to complete affordable housing projects, extending the deadline from two years to five years after permits are issued.
This decision reflects a broader shift within the Commission, which has been criticized for its slow pace in permitting housing developments in coastal areas. The regulatory change comes amid increasing pressure from state lawmakers and housing advocates who argue that the Commission has historically acted as a barrier to essential housing reforms in coveted coastal regions.
New Appointments and Regulatory Changes
Earlier this year, Governor Gavin Newsom appointed several pro-development officials to the Commission, including real estate developer Jaime Lee and local leaders Chris Lopez and Jose Preciado. These appointments were part of an effort to enhance the Commission’s responsiveness to California’s pressing housing needs. The state’s housing shortage has reached critical levels, with many coastal cities experiencing some of the highest housing costs in the nation.
At a recent meeting, Susan Jordan, a conservation activist and founder of the California Coastal Protection Network, expressed optimism about the regulatory amendment. “I think it’s going to have a real-life change,” she stated. This sentiment was echoed by Linda Escalante, a Commissioner who suggested that next year could be an opportunity to educate the Legislature about the Commission’s new direction and improved reputation.
The Commission has also collaborated with housing advocates to streamline the approval process for student housing in coastal cities, further demonstrating its intention to address housing needs. Notably, it did not oppose a significant housing reform law that exempts many new developments from environmental review.
Coastal Housing Challenges and Historical Context
Despite these efforts, critics continue to highlight the stark disparity in housing access along the California coast. A report by the United Nations Development Programme indicates that two-thirds of coastal residents are white, which raises concerns about equity and representation in housing policies. Less than 2.5% of California’s population resides in coastal zones, which account for a mere 1% of the state’s land yet house some of the most valuable properties.
The Coastal Commission was established in 1972 in response to environmental concerns following the Santa Barbara oil spill. Its mission has been to protect California’s natural coastline while ensuring public access to beaches. However, over the years, tensions have arisen between the Commission’s conservationist agenda and the urgent need for more affordable housing. Critics argue that the Commission’s priorities have not aligned with the fast-paced housing reforms advocated by lawmakers.
In recent years, scrutiny of the Commission has intensified, particularly under the Newsom administration. The governor has publicly criticized the Commission’s broad powers, especially during recovery efforts after natural disasters. For instance, he suspended some of its authority following wildfires in the Los Angeles area, which underscored the tension between environmental protection and urgent housing needs.
As the Commission adapts to new leadership and regulatory changes, pro-housing advocates are hopeful that these developments will lead to more inclusive housing policies. “We now have three out of 12 voting members who are appointed to the Commission in this period when many legislators and the governor want reform,” said Louis Mirante, a lobbyist with the Bay Area Council.
